Please read this agreement carefully. It constitutes a legally binding contract between you and KENILGLOBAL TECH PRIVATE LIMITED.

1. Introduction and Acceptance of Terms

This Master Terms of Service and End User License Agreement ("Agreement") governs your access to and use of the Vyoma social network, including the Vyoma website (vyomasocial.com), mobile applications, APIs, and all associated services (collectively, the "Platform" or "Network"). The Platform is operated and maintained by KENILGLOBAL TECH PRIVATE LIMITED ("Company", "we", "us", or "our").

By registering for an account, accessing the Platform, or transmitting any data through the Network, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to every provision of this Agreement, you must immediately cease all use of the Platform and uninstall any Vyoma software from your devices.

2. Definitions

  • "Node" or "User": Any individual or entity that registers an account and accesses the Network.
  • "Public Drop": Any text, image, or media posted to the global timeline or a public profile.
  • "The Vault": Vyoma's secure 1-on-1 direct messaging system, which utilizes local device keys to perform End-to-End Encryption (E2EE).
  • "Anomaly": Content that violates these Terms or is flagged by the community moderation protocol.
  • "CSAM": Child Sexual Abuse Material.
  • "LEA": Law Enforcement Agencies of competent jurisdiction.

3. Eligibility and Age Restrictions

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account on Vyoma. The Platform is strictly not intended for minors. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this binding contract. If we determine that an account belongs to a minor under the age of 18, it will be immediately terminated without notice, in compliance with COPPA (Children's Online Privacy Protection Act) and global equivalents.

4. Absolute Zero Tolerance: Child Exploitation

KENILGLOBAL TECH PRIVATE LIMITED maintains an absolute, uncompromising ZERO TOLERANCE policy regarding the distribution, solicitation, promotion, or viewing of Child Sexual Abuse Material (CSAM), child pornography, or any form of child exploitation, grooming, or endangerment.

Enforcement Protocol: Any Node found to be associated with CSAM will trigger our highest level of disciplinary action:

  1. Immediate, unappealable Permanent Identity Ban (see Section 6).
  2. Immediate preservation of all available account metadata, IP addresses, connection logs, and hardware identifiers.
  3. Mandatory reporting of the User, along with all preserved data, to the National Center for Missing & Exploited Children (NCMEC) via their CyberTipline, as well as direct coordination with the Internet Watch Foundation (IWF), INTERPOL, and domestic cybercrime authorities.

5. Prohibited Conduct & Acceptable Use

Vyoma champions unrestricted thought, but it is not a sanctuary for illegality. You agree that you will not use the Platform to engage in, facilitate, or promote any of the following activities:

  • Illegal Acts: Violating any applicable local, state, national, or international law, statute, ordinance, or regulation.
  • Explicit Sexual Content & Revenge Porn: Distributing hardcore pornography, non-consensual intimate imagery, bestiality, necrophilia, or using the platform for prostitution, sex trafficking, or sexual solicitation.
  • Terrorism & Extremism: Promoting, organizing, financing, or recruiting for terrorist organizations, or inciting real-world violence, genocide, or mass casualty events.
  • Harassment & Doxxing: Engaging in targeted, severe harassment, extortion (blackmail), swatting, or publishing the private, personally identifiable information of others without explicit consent (doxxing).
  • Fraud & Cybercrime: Distributing malware, ransomware, phishing links, conducting financial fraud, money laundering, or selling stolen credentials/credit cards.
  • Network Degradation: Launching Distributed Denial of Service (DDoS) attacks, spamming the feed, unauthorized scraping, or deploying automated bots to manipulate the chronological algorithm.

6. Permanent Identity Bans

We reserve the right to suspend, terminate, or permanently ban any User at our sole discretion, with or without notice, for any violation of these Terms. For severe violations (CSAM, terrorism, network attacks, revenge porn), Vyoma employs Permanent Identity Bans. This includes, but is not limited to, the cryptographic blacklisting of your hardware device fingerprint, IP address subnets, email address, and associated metadata to prevent you from ever accessing the Vyoma network again.

7. Law Enforcement & LEA Compliance

KENILGLOBAL TECH PRIVATE LIMITED respects the rule of law. We will comply with valid, legally binding requests from Law Enforcement Agencies (LEAs), including subpoenas, search warrants, and court orders.

Data Surrender: Upon receipt of a valid legal request, we will surrender all requested, accessible data, which may include account creation details, IP connection history, Public Drops, and network metadata.

E2EE Limitation (The Vault): Direct messages sent within "The Vault" utilize Elliptic Curve Diffie-Hellman (ECDH) key exchange and AES-GCM symmetric encryption. The private decryption keys remain exclusively on the communicating Users' devices. We do not possess these keys. Therefore, it is mathematically impossible for us to decrypt or surrender plaintext Vault messages to law enforcement or any third party, regardless of the legal demand.

8. User Content, Ownership & Licensing

You retain full ownership of any intellectual property rights that you hold in the content you submit to the Platform ("User Content"). However, by posting Public Drops, you grant KENILGLOBAL TECH PRIVATE LIMITED a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to host, store, cache, route, transmit, display, and distribute your User Content for the sole purpose of operating the Vyoma network.

9. E2EE Liability & Data Loss

Because The Vault uses strict End-to-End Encryption, we have zero mechanism for password or key recovery. If you lose your device, uninstall the application without a backup, or forget your cryptographic passphrase, your Vault messages are destroyed permanently. You accept 100% responsibility for your own data redundancy, key management, and physical device security. KENILGLOBAL TECH PRIVATE LIMITED assumes absolutely zero liability for lost data, intercepted devices, or user-side security breaches.

10. Community Moderation (Anomalies)

Vyoma utilizes a decentralized community moderation system. Content that is heavily reported by Nodes as an "Anomaly" may be automatically hidden, deprioritized, or purged from the chronological feed to protect network integrity. Continued generation of Anomalies will result in an automated shadow-ban or permanent termination of the offending Node.

11. Intellectual Property & DMCA Policy

We respect the intellectual property rights of others. If you believe your copyrighted work has been infringed upon via a Public Drop on Vyoma, you may submit a takedown notice pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent at help@vyoma.kenil.in. Vault messages cannot be moderated for copyright infringement as we cannot view their contents.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENILGLOBAL TECH PRIVATE LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE NETWORK WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE PLATFORM ENTIRELY AT YOUR OWN RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KENILGLOBAL TECH PRIVATE LIMITED, ITS FOUNDERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA (INCLUDING VAULT MESSAGES), OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US (IF ANY) IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to defend, indemnify, and hold harmless KENILGLOBAL TECH PRIVATE LIMITED and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party right, including copyright, privacy, or property rights; or (iv) any claim that your User Content caused damage to a third party.

15. Dispute Resolution & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which KENILGLOBAL TECH PRIVATE LIMITED is registered, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

16. Export Controls & Sanctions

You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a comprehensively embargoed country, nor are you listed on any government list of prohibited or restricted parties.

17. Severability & Entire Agreement

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. This Agreement constitutes the entire agreement between you and us regarding the use of the Platform and supersedes all prior agreements.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. All changes are effective immediately upon posting to this page. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
